CHEHALIS – The couple who skipped out on their court hearing in which they were to be sentenced for the severe neglect of their teenage son were located yesterday in Myrtle Beach, South Carolina.

Anthony S. Foxworth Sr., 45, and Mary G. Foxworth, 43, were taken into custody based on a no-bail warrant issued in Lewis County Superior Court.

The Foxworths pleaded guilty last month to first-degree criminal mistreatment and failed to appear in court on Wednesday afternoon.  They were facing a standard sentencing range of 51 months to 68 months in prison.

Centralia Police Department detective Patty Finch said she got word just before 12:15 p.m. yesterday the couple was in custody.

Officers with the Myrtle Beach Police Department contacted the Foxworths at a motel after spotting their green and gray Chevrolet Suburban in the parking lot. An incident report indicates police there had been contacted by investigators from Centralia who passed along information about the general location where they could be found.

They have been booked into jail and presumably will be extradited back to Lewis County.

The Foxworths had been out of custody since the beginning of the case on unsecured bonds.

When the case was first charged in December of last year, the court files for the two showed they resided on South Tower Avenue in Centralia, but Finch said this week police found their home vacant and that Mary Foxworth had been living in an apartment in Olympia.

Centralia police began investigating in January of last year, after couple took their 16-year-old son to the doctor, and he was hospitalized with severe malnutrition, weighing just 54 pounds.

Prosecutors alleged the boy had not seen a doctor since 2007 and had not been enrolled in school since 2011, yet had two siblings who appeared healthy and presented little concern.

CHEHALIS – Authorities said law enforcement would go look today to try to find a Centralia couple who didn’t show up for their sentencing hearing in a case of the severe neglect of one of their children.

Mary G. Foxworth, 43, and Anthony S. Foxworth Sr., 45, are facing prison terms of as long as more than four years. Each pleaded guilty last month separately to one count of first-degree criminal mistreatment.

They were charged late last year after an investigation that began almost a year earlier. When they first appeared before a judge in Lewis County Superior Court in January, they were allowed to remain free on $10,000 unsecured bonds.

The Centralia Police Department got involved after the Foxworths took their 16-year-old son to the doctor with abdominal pain, and he was was hospitalized, suffering from severe malnutrition, severe constipation and anemia, according to Lewis County Deputy Prosecutor Melissa Bohm. The boy weighed just 54 pounds, was missing patches of hair, could not stand on his own and had not seen a doctor or been enrolled in school for years, according to the allegations.

Most benches in the courtroom today were filled for the hearing that was scheduled for 2 p.m.

Lewis County Senior Deputy Prosecutor Will Halstead, just after 2:15 p.m., told the judge neither defendant was present, although both were aware of the hearing.

Defense attorney Jacob Clark said the last time he’d heard from his client was Monday. Anthony Foxworth’s lawyer Chris Baum said his client had checked in on Monday as usual.

Judge Joely O’Rourke agreed to sign no-bail bench warrants for the couple.

Among those who were present was their son, now 18 years old. He looked well. Halstead said prior to the hearing he hadn’t decided whether he would address the court.

He was accompanied by at least a half dozen individuals wearing black leather jackets emblazoned with the logo of their group, Bikers Against Child Abuse.

One of the group from Kelso, who only gave his “road name” of Pops, said they work to support young victims.

“We want them to know, that child’s got someone protecting their back,” he said.

Clark said after the hearing adjourned, he asked Mary Foxworth’s mother to go check on her, as there have been mental wellness concerns.

Clark said he believes the couple no longer resides together, nor do their other two children live with them.

Baum said he didn’t know why they weren’t at court, and he didn’t want to speculate.

Halstead said the plan was to send law enforcement to look for them and pick them up this afternoon.

MATTRESS CATCHES FIRE

• Firefighters were called about 12:30 a.m. today to a house on Northwest Quincy Place in Chehalis after a smoke alarm alerted an upstairs family to a fire on the ground level. The downstairs resident was at work and for an unknown reason, the mattress on her bed was burning, according to Firefighter Kevin Reynolds. When the crew arrived, the upstairs resident was pulling the smoldering mattress out the front door, Reynolds said. Reynolds credited the working smoke detector that caused the upstairs resident to go look around downstairs for saving the building. It could have been a very different story, he said. “Nobody would have noticed, because she was not home,” he said.

AUTO THEFT

• A white 2002 Ford van left unattended while it was warming up this morning was stolen from the 2600 block of Cooks Hill Road in Centralia. Police called at 6:39 a.m. say the vehicle was taken by an unknown suspect and has a license plate reading 693 ZAA.

OTHER THEFT

• A Chehalis resident contacted police about 10:10 a.m. yesterday to report fraudulent charges to his bank account. Police are waiting for further information, according to the Chehalis Police Department.

CAR PROWL

• Centralia police were called just after 4 p.m. yesterday to the 400 block of West Pear Street where someone had stolen a wallet and papers from a vehicle. They also attempted to start the vehicle, according to the Centralia Police Department.

SUSPICIOUS CIRCUMSTANCES

• Chehalis police were called about 6:05 p.m. yesterday by an individual reporting someone had been tampering with a lock on a storage shed at the 1500 block of North National Avenue.

FROM THE COURTHOUSE

• A 19-year-old Chehalis resident appeared in Lewis County Superior Court this afternoon, facing felony charges of four counts of communication with a minor for immoral purposes. Hayden VonBargen was summonsed to court following an investigation that began April 19, with the Pe Ell Marshal’s Office. He and the girl – who reportedly told VonBargen she is 13 but almost 14 when they communicated over the Internet – allegedly knew each other from a youth group and engaged in sexually explicit conversations, according to charging documents. He was allowed to remain out of custody with an unsecured bond. His arraignment is Thursday.

• An 18-year-old Winlock resident was charged today with second-degree burglary for an incident over the weekend in which he allegedly went onto the porch of home inside a fenced property with a claw hammer, waking up the residents who thought he was using it trying to break in. Lewis County Chief Criminal Deputy Prosecutor Brad Meagher told the judge this afternoon that further information he learned suggested it maybe was not a random event by an intoxicated person. Meagher said Steven E. Dodds may have ties to a gang known for destruction of property, given a Juggalo tattoo on his arm. When police responded to the approximately 3:15 a.m. call on Sunday to the 1400 block of Northwest Kerron Avenue in Winlock, Dodds was reportedly still on the porch, soaking wet and shivering, according to charging documents. The resident told police later on Sunday the suspect also had poured starter fluid over the porch by the door and said he was going to set it afire, giving various reasons for that, including because he was cold, the court documents relate. Dodds was booked into the Lewis County Jail. However, on Monday afternoon when he was brought before a judge, prosecutors had not yet decided to file charges and he was allowed release on a $5,000 unsecured bond. He returned to Lewis County Superior Court this afternoon with his mother, after charges were filed and Judge Joely O’Rourke said his conditions of release would be modified with a 6 p.m. curfew. He has no criminal history. His arraignment is Thursday.
