Appeals court reverses conviction in Vader child death

CHEHALIS – The former Vader man incarcerated for his role in the abuse, neglect and death of a toddler he and his wife were caring for will be allowed to withdraw his guilty plea, an appeals court has ruled.

Danny A. Wing was given nearly 35 years when he was sentenced in Lewis County Superior Court in September 2015. He had pleaded guilty to first-degree manslaughter and third-degree child assault for the death a year earlier of 3-year-old  Jasper Henderling-Warner.

His wife entered into a similar deal with prosecutors and received a similar sentence.

A unanimous decision of a three-member panel of the Washington State Court of Appeals, Division II issued on Tuesday concluded Wing’s plea was premised on an incorrect offender score for the third degree assault of a child conviction, rendering the plea involuntary.

His offender score was improperly calculated at six rather than five, an error the state conceded, and therefore resulted in applying the wrong standard sentencing range, the appeals court wrote. An offender score is related to a person’s previous felony convictions.

For the assault, the range ought to have been 17 to 22 months instead of 22 to 29 months, according to the decision.

Wing was given 416 months for the manslaughter and the two sentences were ordered to be served concurrently. The state argued the error did not determine Wing’s ultimate sentence.

A plea agreement must be treated as “indivisible” and an error on one count means the entire agreement must be set aside, Justice P.J. Worswick wrote.

The family, from the Vancouver area, had  been living in the Vader house about two weeks when the Wings called 911 to say the toddler was unconscious and not breathing on on Oct. 5, 2014. Jasper’s 21-year-old mother had given the couple temporary custody while she was homeless and looked for work out of state.

The autopsy found abrasions, bruises, facial trauma and healing fractures and labeled the cause of death as chronic battered child syndrome. Jasper was suffering from skin infections that were found to be secondary to his cause of death.

Lewis County Superior Court Judge Nelson Hunt called it an incredible story of horror and suffering inflicted.

Wing, now 28, appealed his sentence based also on another issue, claiming prosecutors breached the plea agreement.

His appeal lawyer Lisa Elizabeth Tabbut argued the agreement permitted the state to argue for sentencing enhancements but not to file aggravating factors, but the appeals judges disagreed with the distinction.

Lewis County Senior Deputy Prosecutor Sara Beigh argued the appeal case for the state.

It’s not clear exactly what happens next.

“We don’t know, that’s the long and the short of it,” Lewis County Prosecutor Jonathan Meyer said today.

Wing may petition the state Supreme Court to review the part of the appeal decision he lost, Meyer said. If he doesn’t or even if he does and fails, the case will be back in Lewis County Superior Court, he said.

“Then he gets to choose whether he wants to withdraw his guilty plea or not,” Meyer said. “He can opt to do that and if he does, we go to trial.”

Meyer suggested if Wing were to go to trial on one of the original charges, homicide by abuse with aggravators, and lost, the potential sentence could be lengthy.

Brenda A. Wing was sentenced in January of last year to 34 years and eight months for first-degree manslaughter, third-degree child assault, two counts of witness tampering and two counts of possession of a controlled substance.

She also has an appeal in the works.

CHEHALIS – The (Ellensburg) Daily Record reports a Kittitas County judge yesterday dismissed a case against Salkum resident Tod Reichert and his guide in connection with the shooting death of a well-known elk named Bullwinkle because of vague language in the state hunting regulations.

Reichert had been charged last year with second-degree unlawful hunting of big game in a field not permitted for hunting.

The Yakima-Herald Republic last year wrote the animal who lounged in people’s yards was thought to be the biggest bull elk in the Kittitas Valley.

News reporter Brian Myrick writes Reichert’s attorney Steve Hormel said he and his client were happy with the outcome and believed it was the correct decision but prosecutors will decide whether to appeal the ruling within the next 30 days.

BREAK-IN CENTRALIA

• Centralia police were called just before 7 p.m. yesterday for a burglary at a home on the 500 block of West Cherry Street. Tools were stolen, according to the Centralia Police Department.

FORGERY

• An individual at the 1200 block of Alder Street in Centralia reported yesterday morning possible fraud involving someone writing checks on his account. The case is under investigation, according to the Centralia Police Department.

OTHER ARREST

• A 32-year-old Randle resident was arrested for for interfering with a health care facility after police were called to the 900 block of South Scheuber Road in Centralia at 1:50 p.m. yesterday. Kelly A. Holen was booked into the Lewis County Jail, according to the Centralia Police Department.

DRUGS

• A small vial containing a white crystal substance was found inside the sock of a woman getting booked into the Lewis County Jail last night leading to her arrest for possession of methamphetamine.  A deputy arrived just after 9 p.m. to the area along state Route 6 near Steven Road in Doty to assist the woman who had called in because she was having vehicle issues, according to the Lewis County Sheriff’s Office. The deputy ran her name through the system, discovered she had an outstanding warrant and took 33-year-old Grace K. Mathison of Kent to the jail, according to the sheriff’s office.

VANDALISM

• Centralia police took a report from the 400 block of Centralia College Boulevard just after 10 a.m. yesterday that an unknown person or persons broke into a vacant residence and flooded the living area by turning on all of the water faucets and damaging the drains.

• An individual reported yesterday evening after discovering their vehicle had two flat tires and taking them in for repair, it was learned they had been slashed while parked at the 200 block of Southeast Washington Avenue, according to the Chehalis Police Department.

• An adult male suspect was contacted after punching a passing car, causing damage to the vehicle at Locust and South Pearl streets in Centralia yesterday morning around 11:15 a.m., according to the Centralia Police Department. The incident is under investigation, according to police.

• Centralia police report they are investigating an incident in which the driver left the scene of a crash at the 600 block of North Gold Street sometime before 7:52 p.m. yesterday. The vehicle left the roadway and struck an embankment, according to the Centralia Police Department.

• A 48-year-old Toledo man was arrested last night after a witness reported seeing his vehicle nearly hit a guard rail, run into a ditch, almost cause a head-on crash after crossing the center line and travel at speeds varying between 10 mph and 50 mph. A deputy arriving about 9:30 p.m. to the area on Jackson Highway near Tucker Road contacted Rodney Wallace, conducted field sobriety tests and then booked him into the Lewis County Jail for driving under the influence, according to the Lewis County Sheriff’s Office.

ROPE TRICK FAILS AT GREEN HILL

• A 17-year-old student-inmate is facing a possible charge of first-degree attempted escape after an incident in which he took off running and tried to throw a hand-made rope over the fence at Green Hill School. An officer called yesterday to the state juvenile detention facility was told the youth got 400 to 500 yards away from the group he was with before he was apprehended, according to the Chehalis Police Department.

THEFT, THEFT, THEFT

• An individual at the 1500 block of Lewis Street in Centralia reported yesterday afternoon someone broke into his coin-operated laundry machines and took the money from them, according to the Centralia Police Department.

• An outside security camera was stolen from a business on the 300 block of Lowe Street in Centralia, according to a report made to police about 1:20 p.m. yesterday.

• Centralia police took a report yesterday morning of the theft of a package delivered to a front porch at the 700 block of North Washington Avenue.

• Chehalis police were called about 6:30 a.m. yesterday to the 1100 block of South Market Boulevard after a woman attempted to spend a fake $50 bill at Starbucks inside Safeway. The counterfeit money was left behind and the subject took off in a white Honda Accord, according to the Chehalis Police Department.

VEHICLE PROWL

• An officer was called to the 1400 block of Northwest Airport Road in Chehalis about 3:45 p.m. yesterday after a woman learned the driver’s side window of her vehicle was broken out and her purse stolen.

• Centralia police were called about 3:10 p.m. yesterday about the theft of a battery from a travel trailer at the 700 block of J Street.

• A wallet was taken from a vehicle parked at the 900 block of South Scheuber Road in Centralia, according to a report made to police about 7:40 p.m. on Monday.

DRUGS

• A 32-year-old woman arrested shortly after 9 a.m. yesterday at the 500 block of Harrison Avenue in Centralia for an outstanding warrant was also arrested for possession of methamphetamine. Christina A. Leyva, of Lacey, was booked into the Lewis County Jail, according to the Centralia Police Department.

SEXUAL ASSAULT

• Centralia police yesterday evening decided to refer a case to juvenile prosecutors regarding an allegation of second-degree rape against a 16-year-old boy, according to the Centralia Police Department. The teen is already in custody on an unrelated matter, according to police. Further details were not readily available.

VANDALISM

• A deputy was called over to the Lewis County Jail about 8:20 p.m. yesterday because an inmate had allegedly intentionally broke a sprinkler head. A case against Jeremy J. Miner, 41, will be referred to prosecutors for a charge of malicious mischief, according to the Lewis County Sheriff’s Office. Miner reportedly told the deputy he broke it because he wanted to inhale the cigarette smoke he thought was emanating from the object, sheriff’s Chief Deputy Dusty Breen said. The loss is $300.

ON THE ROAD, OFF THE ROAD

• A Toledo police officer was apparently unhurt when his patrol car sitting in a parking lot facing Front Street at Cowlitz Street was struck by a Toyota Tacoma yesterday afternoon. A deputy called to investigate about 2:50 p.m. determined the 35-year-old Toledo man driving the truck had suffered some sort of medical issue which led to the collision, according to the Lewis County Sheriff’s Office. The truck sustained minor front end damage and the 2008 Dodge Charger was left with minor damage on the front passenger side headlamp, according to the sheriff’s office. The 35-year-old was transported to Providence Centralia Hospital for evaluation, Chief Deputy Dusty Breen said.

• Centralia police reported yesterday they were looking for a white 1991 Honda Civic hatchback which sped away recklessly following an attempted traffic stop at Harrison Avenue and northbound Interstate 5 about 12:30 p.m. on Monday. An officer got its license plate which reads BBR 4040, according to the Centralia Police Department.

News brief: Onalaskan asks law for help with drug issue

CHEHALIS – A 40-year-old Onalaska woman handed over a baggie of suspected heroin to a deputy last night after calling Lewis County dispatch and telling them she wanted to get clean and get into rehab, according to the Lewis County Sheriff’s Office.

A deputy responding to the 100 block of Third Street in Onalaska following the approximately 11:20 p.m. call field tested the brown powdery substance, arrested Elizabeth A. Fiedler for a violation of the Uniform Controlled Substances Act and booked her into the Lewis County Jail, sheriff’s Chief Deputy Dusty Breen said this morning.

A possible charge of possession of drug paraphernalia is being referred to prosecutors.
