CHEHALIS – A second young man has been arrested from a 2012 case in which a 13-year-old girl told police she was taken advantage of by three males at a Centralia party when she was so drunk she could not walk.
Geffrey A. Duncan, 22, went before a judge yesterday afternoon in Lewis County Superior Court, where he is charged with second-degree rape of a child.
The Chehalis resident came to court with his father, having bailed out of jail following his arrest on a $25,000 warrant.
The judge signed a protection order, prohibiting Duncan from contacting the alleged victim.
Temporary defense attorney Joely O’Rourke indicated to Judge Nelson Hunt her client could have trouble abiding by the order.
“He says he doesn’t know the victim, has no idea who she is,” O’Rourke said. “He’s not sure how to avoid (her).”
Judge Hunt told Duncan he needed to stay at least 1,000 feet from Centralia College, avoiding giving the girl’s address.
Earlier this summer, Centralia police arrested 19-year-old Tyler M. McKee, who was living in Las Vegas. He was charged with the same offense and remains in the Lewis County Jail with bail set at $100,000.
The allegations were investigated in May of 2012, and forensic evidence collected, but the girl only knew the first names of two of the individuals, according to court documents.
Last year, a detective at the Centralia Police Department interviewed a new witness and was given Duncan’s name, and Duncan subsequently recalled being at the party and said he may have kissed her once, according to court documents. He accused two of his friends of having sex with the girl after being told she was only 13, court documents relate.
Duncan’s DNA was excluded from the sample found on her pants.
Court documents in the case relate the girl said she’d never been intoxicated before, but played beer pong and “shot gunned” approximately 10 beers. She told police she remembered both “Tyler” and “Jeff” being on top of her, one after the other. She recalled a third man who came into the room and put his penis in her mouth, according to the court documents.
The new witness reportedly told a detective he tried to get Duncan out of the room but Duncan refused to leave, according to court documents.
O’Rourke told the judge yesterday that Duncan was asking for a court-appointed lawyer, as he didn’t think he could afford to hire someone.
“He makes about $4,000 a month, but he has about $3,000 a month coming out of his pocket,” O’Rourke said, citing bills such as $600 a month truck payment, a $200 a month phone bill, $600 a month obligation for his show dog and payments on haying equipment loans.
Hunt didn’t appoint him a lawyer, but told him to return in two weeks after talking with attorneys about their costs, and tell him again why he can’t afford to hire someone.
His next court hearing is Sept. 29.

I know Geffery Duncan very well! He is a very good person and he would NEVER DO ANYTHING LIKE THIS!!!!!! I have known Geff and his family for years, they are very honorable, upstanding, God fearing people! Geff and his family helped me and we’re there for me more than just about anyone. I would probably throw myself in front of a bullet for Geff and his family. This is a witch-hunt! The Lewis County Prosecuting Attorney’s Office and the investigators who are pushing this case should be ashamed of themselves. If Geff Duncan is convicted of this meritless allegation, I will make it m life’s mission to help him get exonerated!
This loose 13 year old girl is the product of internet porn, domestic violence reporting, girls gone wild and feminism. On a positive note atleast they put it on her face and she didnt have a abortion. Progress,…. and you dont even know it lol.

This is not a question of a 13 yr old girls character. Oblivious she made some poor decisions as most humans do but this is in regards to whether or not a crime was committed. “Incoherent to give consent” is the point of this. A person who is intoxicated doesn’t automatically give consent to sexual acts. The mind will slip in and out of an intoxicated state especially if beer was the main substance consumed. Whereas hard alcohol will knock you out cold. It is natural for a person to be passed out drunk and when something starts to occur that they are trying to defend or get away from they will try and fight going on conscience and they will come in and out of memory and she was probably trying to fight them off in her drunken State and probably couldn’t even say no and if she did was an acknowledged. So let’s reflect she may have made poor decisions but she did not do a criminal act harming another person she was a minor consuming alcohol she did not inflict harm on herself sexually that is a criminal offense that is assault
This story doesn’t even make sense. 1st how did a 13 year old girl went to drink and how did her parents let that happened… How do we know that it wasn’t her fault. She is only 13 years old and she would get drunk really fast from a beer… How do we know she wasn’t the one who instigated that action and regretted letter… Or how do we know she is not regretting her actions and trying to turn this situation around to make her self a victim…How can she or he remember all the details from that night that long ago… I can see him remember more than her because he is older than her… But still she was drunk and why don’t we talking about her all we hear is it was him but what about her… well I can tell you why because she was to young to remember anything and drunk so her story would change a lot… and people don’t want to hear the bad side of her and it’s not right if you working on this situation than don’t take sides. You suppose to be innocent until proven guilty not tried in the press.
