Toledo teen charged in adult court for allegedly taking bat to father’s head

CHEHALIS – The Toledo High School student arrested for allegedly assaulting his father early Thursday morning had come into the room where his parents were arguing about the father’s extramarital affairs when he hit his father in the head with a baseball bat, according to lawyers and charging documents in the case.

The 55-year-old father was described in critical condition when he was airlifted to Harborview Medical Center in Seattle. He has been upgraded to satisfactory condition.

Th 16-year-old was charged today in Lewis County Superior Court with first-degree assault, domestic violence; a crime with a maximum penalty of life in prison.

He appeared before Judge Richard Brosey.

Lawyers said although he’s a juvenile, because he’s charged with a serious violent offense and is at least 16, he is automatically subject to adult jurisdiction.

Lewis County Chief Criminal Deputy Prosecutor Brad Meagher told the judge the teenager observed his parents arguing, came up behind his father and struck him with the bat.

Temporary defense attorney Bob Schroeter argued for low bail, noting the boy is a good student and the father is recovering quickly.

“I think you’ll see the argument caused (him) to act out,” Schroeter told the judge. “Though I’m not going to get into the facts of the case.”

Schroeter said the father is about to be released from Harborview and transferred to a Longview hospital and has conversed with family members.

“He’s doing phenomenal,” Schroeter said.

The lawyer proposed the teen has two adult brothers – one in Chehalis and one in Kelso – willing to take him in, since there will be a no-contact order in place between the boy and his dad.

Judge Brosey disregarded Schroeter’s request and set bail at $75,000.

“The mere fact that he was struck in the back of his head, that’s the kind of injury that easily could have been fatal,” Brosey said.

Charging documents describe the police call to the home on Oak Street where Leslie Bagley was laying in the middle of the living room floor with a large pool of blood.

Police stated the mother Tena Bagley had been drinking and appeared intoxicated.

“Tena Bagley, Leslie’s wife, reported she and Leslie were talking about Leslie’s extramarital affairs when (their son) came into the room and hit his father in the head with a metal baseball bat,” charging documents state.

Afterwards, he apparently took a beer and left the residence, charging documents state.

The teenager was arrested later in the morning, when police returned to the home and found him hiding under a bed, according to charging documents.

He was taken to the  Lewis County Juvenile Detention Center but has been transferred to the Lewis County Jail.

Chehalis attorney Chris Baum is appointed to represent him.

The arraignment is set for Thursday morning.

    Belinda, Sharyn reports the FACTS as reported to her. FACTS. “FACTS” means, in this case, “NOT FANTASY.” She also doesn’t pass judgement like so many other media outlets do. She just reports the FACTS as they are. She does NOT assume anything, but uses “alleged”, simply because when a person is charged with a crime, it doesn’t mean they are guilty… they have “allegedly” committed the crime, and it is up to the legal system to determine if “alleged” becomes “actually did it.”

    Now, you continue to say that you know “the truth”, yet you absolutely refuse to divulge that “truth” to the world, claiming this as an on-going case. Fine. You better contact an attorney… specifically, the defense attorney for your pal… because I’m pretty sure that the courts would be interested in hearing what you have to say. And if what you say is the real “truth” (which I highly doubt), then the sooner you do so, the better.

    But just because you claim to know something doesn’t mean that Sharyn is a bad reporter…. she is doing her job better than any other local reporter would (and by local, I mean anyone in Washington, Oregon, Idaho, and beyond…)

    Belinda, what does the fact that this is an “ongoing case” have to do with your unwillingness to tell us what you claim to know? It’s at least a little disingenuous of you to take Sharyn to task for not reporting information she doesn’t have, yet claim you can’t say what she’s missing.

    George, as I said before this is an on going case and cannot comment on the facts as I know them.And as for Sharyn reporting honest and TRUE (not) facts,I think not. She reports on” allegedly”and assumptions, and you all know what assume get you dont you?

    Belinda, Sharyn reports the “facts” as reported to her from the local agencies, not the “facts” that some “member of the family” insists on being true. And since you refuse to enlighten the world with what you say are the “facts”, we have to go by what is reported.

    So as others have said, “enlighten us with the facts as you see them.” Or, let us get our facts from a source that is true and honest in reporting what she reports.

    all tho I would love to let the facts be known,but I cannot, it is an on going case and the police need to figure out the facts on their own,and work with true facts and not speculations which leds to bad reporting, I am too close to the family to comment. But if you are a good investigator,,,,,,just saying.

    Though I do find it interesting that the father and mother were fighting over HIS affairs, and there have been at least two females that seem to be defending the father….

    I just have a few words for the so called reporter, apparentley ms.Decker you r not the kind of reporter that makes sure her facts r true, you are just like all the rest of those rag tag shitty reporters that rely on hear say and gossip, how sad. Let me tell you what makes a great reporter, one that is repected: Honesty is first and foremost, getting the facts straight and not relying on” allegedly” is second, and last but not least not reporting fiction, leave that for the fiction writers, they do alot better job. GET YOUR FACTS STRAIGHT!!

    IF it was about my family I’d either avoid the Sirens (if I didn’t want to read about what others were saying), or I’d read it and keep my fingers away from the key board OR I’d set the record straight so everyone knew the facts.
    By now everyone should understand that people are going to make comments (if they know the people involved or not) and are going to speculate about what happened…get used to it!

    Unless you are from toledo, related to the family, or personally know the family you all should keep your comments to yourselves. Everyone is entitled to their own opinions but not everyone needs to hear them. I think its completely ridiculous when people comment on situations they know nothing about. How would you all feel if this were about someone you loved and cared for and you had to read comments like these. Go on about your own lives and butt out of other’s business!!!! Accusations of domestic violence are demeaning and just down right rude. You people make me sick

    Wow you guys amaze me. This family has a history of domestic violance and the son was doing the right thing in protecting his mother as any man would do. I know for a fact that i wouldve done the same thing in that situation

    That statement is seriously stupid. I know plenty of people who don’t lose their morals or values when drinking or smoking pot (other drugs, maybe). In fact, I know people who become way more laid back and LESS violent when they drink.

    More likely that the kid learned his lack of personal responsibility from his father.

    YES the youth should be held responsible for his actions.

    YES his father should be held responsible for his.

    No the father did not deserve such treatment, but it is reasonable to suggest that the youth was very affected by the emotional (alcohol related or not) events. Not excusing his actions, but understanding some of the situation.

    My guess is the alcohol played the biggest factor – the “adults” were drinking and the kid grabbed a beer on his way out.

    If everyone had been sober, my guess is there would have been no assault. I doubt it had anything at all to do with values, morals or ethics because those all disappear with enough alcohol or drugs.

    @ “huh”, how is this too bad for the kid that it went this far? Did his father put the bat in his hands? I doubt it. Was he under instructions to nail someone in the back of the head? I doubt it. If anything, it is too bad for the victim, and a good thing for the kid that he survived.

    Or are we just going to make more excuses for what happened, and not hold this person accountable for what he has allegedly done?

    Too bad for the kid that this went as far as it did. Good for him that his two brothers will take him in. Likely he was just doing what the wife was thinking of doing….

    Why oh why do people hurt their families?????? Oh yeah, “personal responsibility” is a lot like “government intelligence”…..

    …..the husband didn’t have that affair on his own…..
