Packwood teen’s suicide to be revisited, in court

CHEHALIS – Three years ago, a student at White Pass High School took 30 Ibuprofen pills one morning and then went to school.

When his school counselor found out about it, the boy was taken away in an ambulance to Morton General Hospital where he was treated and subsequently released.

Days later, a buddy of his who was also a student at the school attempted suicide, and succeeded.

The 16-year-old, Brian Stephens, had less than a week earlier passed a note to a girl in English class writing that if his friend killed himself, he would too. The girl told two school counselors.

His grandmother, with whom he lived, never heard about the note until months afterward. She wasn’t called when high school counselor Justin Neilson brought her grandson into his office to ask him if he was suicidal.

Stephens’ family has filed a wrongful death lawsuit against the school district, saying a grave lack of professional judgement led the school counselor to dismiss clear signs Stephens was at risk for suicide, that the district did not provide its employees with mechanisms to respond to such situations and that it failed to have a comprehensive school suicide prevention plan.

“Our position is the school district did not address the risks they should have done with Brian,” the family attorney Kevin Coluccio said.

Teen suicide is a huge issue across the country, and it’s an issue that schools need to deal with, Coluccio said.

It’s is the third leading cause of death among young people ages 10 to 24, according to the attorney.

The family, through its attorney, claims the school had a duty to notify his parents the teen was talking about suicide at school.

A key part of student safety is proper parent notification practices, the lawyers write in their filing. If a student says they’re not feeling well, parents are called; if they are behind on their vaccinations or not showing up for classes, parents are contacted, the lawyers write.

The school district’s attorney says it does not have such a duty.

Its responsibility is only to protect students in its custody from reasonably anticipated dangers, according to the lawyer, Jerry J. Moberg.

The school district is represented by Moberg as well as James E. Baker at Jerry J. Moberg and Associates in Euphrata. Also representing them is Tukwila attorney Philip Talmadge.

All that remain of the school officials who were involved in 2009 are three of the five school board members. The school district superintendent Rich Linehan, the high school principal and the two school counselors have since left the district.

White Pass Junior-Senior High School, with about 180 students, is in Randle.

Today, Stephens’ grandmother Debbie Reisert still gets sick talking about it, a loss she says has left a gaping hole in their small family.

“I’m really angry about it,” Reisert said. “But I really haven’t talked about it openly in the town.”

Reisert runs a lodging business on Cannon Road in Packwood. She worries about the impact news of the lawsuit and its details could have on the kids involved, she said; the then-16-year-old friend of her grandson who attempted suicide, the girl who told the school counselor about the note.

Both the current White Pass School District superintendent and the school board president declined to comment, referring questions to their attorneys. The lawyers representing the school district have not returned calls for comment.

A claim filed in January asking $3.5 million was denied. The lawsuit was filed at the end of March in Lewis County Superior Court.

“The thing that’s so frustrating for us is he made an assessment that’s so obviously wrong and didn’t give us a chance to intervene,” Reisert said.

She feels like her only grandson would still be alive, if the school had simply picked up the phone and called, she said.

“Brian was an amazing human being,” Reisert said. “He was really, really intelligent. He was very articulate.”

The oldest of three children, he tended toward the Buddhist philosophy, was funny and was the kind of kid that always helped out the underdog, she said.

His mother took him out of Gig Harbor High School his sophomore year and sent him to live with her in Packwood after he got in trouble with some teens who threw something off a freeway overpass at a vehicle, according to Reisert.

Reisert said she spent about 30 minutes with the school counselor when she enrolled her grandson, explaining about his pending court case, and her concerns about the differences in schools.

She asked him to let her know if he was “hanging out with trouble,” she said, to call if he noticed anything amiss.

It was only about six weeks later he was dead.

Court documents and reports from the Lewis County Sheriff’s Office offer details of the week in May 2009 that ended in the death of the White Pass High School sophomore.

It was Thursday May 21, 2009 when Stephens was found with a gunshot wound to his head, inside a Tacoma man’s vacation mobile home on Richer Drive in Packwood, three days after he went missing from his grandmother’s home nearby.

The sheriff’s office investigation gives the following account of what transpired during the previous seven days:

One of Stephens’ female classmates was among the many students interviewed by detective Bruce Kimsey.

She told Kimsey of the note Stephens had written her, saying he never explained why he wrote it.

A 16-year-old Packwood boy Stephens had known since preschool said he and Stephens recently had conversation about how they would kill themselves if they were ever to do so. They were walking around Hinkle Tinkle Falls behind the boy’s house.

On Friday May 15, 2009, that boy took 30 Ibuprofen pills and then went to school.

After he was sent to the hospital, the girl went to the school counselor with the information about Stephens’ note. Several of the students were talked to at school that day about the suicide attempt.

The counselor Neilson told a deputy he then questioned Stephens about committing suicide.

“(Stephens) had replied he was not going to harm himself and did not feel like harming himself in any way,” the deputy wrote.

Over the weekend, her grandson was upset about his friend’s suicide attempt, and some of the other kids seemed to blame him for some reason, according to his Reisert.

Stephens had talked about running away back to Gig Harbor, according to some of the students.

On Monday May 18, 2009: Stephens grades came in the mail, they weren’t good.

“The thing that’s really difficult for me is I got angry at him that day,” Reisert said. “He got bad grades, he wasn’t turning in his homework. I yelled at him and he took off.”

According to Sandra Zacher, a grade school teacher in the district, Stephens had come looking for her son who wasn’t home that afternoon. She said he hung his head down and walked away.

A runaway report was filed that night, a deputy went to the childhood friend’s house on Richer Drive, where he learned the two boys had recently discussed suicide, and listened to a voice message Stephens had left on his friend’s phone, saying he was going to “do it.”

About 4 o’clock the following morning, Zacher’s doorbell rang, and she went to the front door and saw no one was there.

Reisert and Stephens’ mother, Allison Tinney, continued to look for the teenager.

On Thursday May 21, 2009: They went to the friend’s home, and learned from his mother, Zacher, she had noticed the lights on the previous few days at a nearby vacation mobile home.

The three walked over there, Tinney saw her son’s backpack through a window, went inside and found her son dead on a bed with a .22 Winchester long rifle.

The school district superintendent and high school counselor Neilson were among those who arrived at the mobile home as deputies investigated.

A suicide note was found on the back of a piece of homework in Stephens’ backpack. It contents were blacked out in the copy of the report released by the sheriff’s office.

Court documents show his date of death as Tuesday May 19, 2009.

The suicide seemingly came out of nowhere, according to his grandmother.

“He wasn’t even moody ever,” Reisert said. “Brian was just really even all the time, always smiling.

Reisert said she thinks it was a like a fleeting idea he acted on more or less spontaneously.

The lawsuit names as the plaintiffs Stephens’ mother, as well as William Boehm, personal representative of the estate of Brian Stephens.

It is being handled by Coluccio at the Seattle firm of Strittmatter, Kessler, Whelan and Coluccio as well as the Law Office of Skip Simpson in Texas.

Paige Tangney, a past president of the Washington State Association of School Psychologists who has worked in public schools for more 30 years, was asked by the family’s lawyers to evaluate the circumstances of Stephen’s death.

At a minimum, the counselor should have kept Stephens in his office after they spoke about the note he wrote and then picked up the phone to call his grandmother, according to Tangney.

Tangney writes in her filed declaration that a reasonable standard of care is to take any threat of self harm by a student seriously. She describes the protocols many schools have adopted for dealing with potentially suicidal students.

If a student is determined to be a low risk, the parent can advise about the next steps, and is asked to be home when the student gets home from school, Tangney writes. If medium or high risk, the parent is asked to come to school and pick them up.

Tangney writes it appeared Neilson conducted an informal assessment and concluded the teen was either at low risk or not at risk.

Any one of several items the counselor learned, coupled with the note that threatened suicide, made him a significant risk however, she wrote.

“To make a judgement that a student is not a significant suicide risk when they have stated to another student they are going to commit suicide if another student does, the other student has made an attempt, and he has additional risk factors, constitutes, in my opinion, a grave lack of professional judgement as a school counselor,” Tangney writes.

The school district’s attorney, in an answer filed in early May, denies the warning signs were clear or that the counselor failed to properly assess Stephens.

Also, state employees are immune from liability pursuant to a professional judgement doctrine, the district’s lawyer wrote.

“If there was an error in judgement on the part of a professional employee of the school district, it was an honest error in judgment arrived at within the standard of care the school district employee was obliged to follow,” the attorney wrote.

There is currently no date scheduled for when the parties might meet in court.

    My heart goes out to Brians family….such an tragedy. To Packwoodtrees, as far as favoring and passing football players I know first hand this isn’t true, my son was a football player and was never treated fairly or justly, he was picked on by teachers and tormented til he would lose his temper, then would get suspended. I am glad he has exited White Pass and its lack of leadership.

    All i have to say is White pass staff pretty much sucks!! My sister goes now and bullying is REDICULOUS but as long as you are an avid football player or cheerleader you have it made there!! They make sure you graduate and pass your classes, they will do whatever it takes to pass you as long as you try your best.on the field!! Thats all anyone really cares about!! Zacher and Brian were best friends trying to figure out life and i think the ONLY reason the school did anything for zacher (BRIAN’S FRIEND) is because.his mom worked at the school!! R.i.p. Brian so glad his friend is okay

Whatever the reasons for what happened — and possibly he didn’t even fully know himself, that can be such a painful and confusing time, under the surface — I do wish you had had the chance to address those. As you say, I am sure he knew he was loved. My prayers are with your family as you move forward, of course never forgetting, and heal.

  7. Lets not over look this suicide, yes the school is at fault. But to many other factors play a role in ones mental well being. And I know for a fact that additives in our enviroment play a big role in ones mental wellbeing. I am truely sorry for your loss. But we do need to warn the community about the dangers of our toxic enviroment and the negative health affects it is causing to todays offspring. Never overlook all the possibilities.

    Dirty cop this will be my very last post to you because at this point we are just doing what you want. First off we are not pure as a snowflake however we do our best to keep the toxic stuff that is in so many thing to a very minimum. As for Brians friend you must have not paid mutch attention to what the article said. He is very much alive as the school did call and got him to the hospital right away. So that in it’s self shows that given the right help suicide can be prevented. Yes you are right in the fact that the parents are number one in a childs life. Next then comes the school. We have looked into what all the signs are to look for and Brian did not display any of them. Brian was always joking around with us. That morning he was playing around with my mom before he went to school. We had no idea he was suicidal and if the school would have picked the phone up and called we would have got him the help he needed. He still would be with us today. The loss has devastated our very small family. We will never be the same with out Brian. I find it funny that you can not find any fault or responsibility in the school yet you say to keep kids out. When something happens in this family we all ban together and take action. We have done our best and we are not perfect. Brians death could have and should have been prevented. The girl did all the right things and was shocked to find out that we were not given a call. Suicide in young people is going up and schools should be trained and have protocols on how to handle a potential suicidal child. This school still has nothing in place to fallow after Brian. We want to change that. The bottom line is that it is common sense to call it should not take training. However it is clear that something needs to be put in place so that in hopes this does not happen to any other children. No matter what the cause for someone to be suicidal the school should have protocol. The number one no matter what kind of risk assessments a call should be made. As you would be called if your kid is sick. You can keep wright about your fluoride all I ask is that you don’t talk about Brian. You did not know him or what caused him to do this. Brian was loved very much and has left a gaping hole in our hearts. Even though he was 16 he would still snuggle up with us on the couch or even come and sit in my lap. Brian and his sisters were the center of our family.

    The Governments Training camps are designed to separate the family and allow these type of things to happen to the people’s offspring. Just like Vietnam the Government told the American People that Agent Orange was safe for over ten years. To come to the conclusion that Fluoride was not a factor is laughable. In fact, just the plastic’s alone in today’s enviroment is causing young woman to become fertile sooner and the health affect are still not properly researched. And to say that you shop at all of these so called pure stores is laughable.. The law as it is now allows companys to not label GMO foods. So how do you get all of these pure products when their not labeled by law.
    In larger cities the DEA is warning people on large billboards to not put drugs in the water due to the effects they are having on certain people. Uneducated I think not. I’m willing to explore all possibilities and I’m not tunneled Visioned on blaming the school. That’s like Blaming Sponge Bob or X Box 360. Oh I get it, another free hand out from the school. Yeah it is the Schools fault. Public schools are a Government Eugenic Training camp. And that fact they do train kids a one sided view is typical.

    Dirty cop enforcer I think you have miss understood the entire article and everybodys comments. The point we are trying to make is that the counselor should have contacted the grandmother or mother once he had the knowledge of the letter. Any person wether or not they had drunk flouride for there entire life or only on occasion would have had the common sense to tell somebody that this boy may have been suicidal. You can stick to your flouride rant all you want but the fact of the matter is that if we had known about the letter we would have done something about it. Let me repeat, if we had the knowledge of the letter we would have stopped it. Again if we had the knowledge of the letter we would have stopped it. Do you understand what I am saying? And yes I do blame the school for not informing us of the situation. I am a member of a union and nobody in my family shops at Walmart we buy our food at PCC or whole foods and yes we do have an all organic garden.     You know, I went through public schools and grew up in a locality where they added flouride to the water, and I never once thought about committing suicide. To top it off, I actually became a productive member of society, and took responsibility for anything I might have done. I still do. And I even had my full share of immunizations too.

    To put the blame for a suicide of a young person on flouridation of the waters, or immunizations, or whatever, that’s just stupid and idiotic. That’s about the same as saying that Hitler hated Jews because the colour purple wasn’t green.

    A young person ended his life, for whatever reason, and people should be trying to remember who this young man was when he was alive, not blathering on about some cockamamie nonsense about flouride or immunizations.

I too have been through a Suicide, remember that suicide is a Disease of the mind and anything that can affect the mind like fluoride has no place in the human body…Let me stress again what parts of the Human Body Fluoride attacks.     Brian was my best friend! I spoke with him before he went missing and I know he wasn’t suicidal. Things with Brian need to be figured out. Brian’s death has affected so many people back in Gig Harbor.

We are talking about a suicide and the way a school district mishandled a serious situation that ended with the Loss of a bright, kind and loving young boys life. You got it?     It makes me sick to my stomach that someone (dirty cop) would try and blame the death of brian on fluoride. That is the stupidest thing ive heard all year. I believe that fluoride could possibly have a role in OTHER peoples lives/deaths but my family does not use fluoride or anything that could chemically harm the make up of our brain and bodies. We are all extremely healthy and the fact is, if the counselor would’ve called, brian wouldve gotten the help he so obviously needed. When i was in 6th grade i cut myself ONCE  and my school counselor was told by another student, she immediatley pulled me out of class, took me to the nurse to make sure it wasnt infected then she called my family and when i got home my family was there to help me with my problems. They put me through therapy and everything is fine now. If brian wouldve had the counselor i had, he WOULD still be with us today. There is no excuse for the counselor not calling. So stop with your vaccine and fluoride crap, nobody wants to hear about it because it is irrelevant to this case. Save your comments for a different story.

    P.S. we also have not given our kids vaccines, flu shots, gmo food. We get our eggs from a friend that is all organic. We make sure the little bit of milk the kids do drink is organic and free of steroids, anitibiotics and hormones. We also give our kids homeopathic medicine and use essential oils (my mother is a certified aromatherapist) in the care and treatment of them. Just in case you want to try and blame any of this on what happened with my beautiful nephew.

    Dirty cop I was fine with the first two post that you put on this but now I am getting really up set… first off my mother, Brians grandmother has well water so no fluoride in that. Then our family buys mostly all organic especially fruits and veggies. We also use Toms fluoride free toothpaste. So even if that was not the case and we did drink the water full of fluoride. The school should have called. We take suicide in our family very seriously and we would have found help for him. We are a very small family and very close. We would have not let him out of our sight until finding the proper help. You do not know alot of the facts so please stop going off on your fluoride bit. You now have your info out and people can check it out if they wish to do so. Do not keep talking about Brian this way please. You don’t know him or our family and our history. Thanks

    The fact of the matter is the Counselor has a duty as a Counselor and human being to notify a parent that their child is suicidal. Wouldn’t you take any step that could be taken as a human to try and interven in a suicide….. Being a parent of three I too would be furious if I wasn’t notified. Like it says you are notified for a sick child or a child that is tardy to class but not for your child being suicidal? I don’t even know how the school system could try and justify their case. It’s unexceptable and could have been possibly prevented if they would have just reached out to the parents. Now the family will have to suffer for their lifetime and wonder what if!!!! What if they would have gotten that call and they could have got Brian the help he needed. I am highly disappointed in the school system!!!!

    The fluoride & vaccination claims are ridiculous! Bottom line is this counselor has an obligation to each student to protect them. The counselor failed to do so by not contacting the grandmother, especially since she had personally spoken with the school 6 weeks prior. What is the purpose of having a scoop counselor if they are not there to help and intervene? This is a rather small school, as well, so NO student should be an exception, or fall thru the cracks! Bottom line…the counselor still needed to call the guardians whether it would have made a difference or not. Vaccines and fluoride are not to blame!

    I agree Heather since justin neilsen was aware of it,its part of his job as a counsler..Brian was not a troubled boy and neither was the other boy..Brian was new to district..also after justin neilsen has spoke w Brian and was aware he had a problem why didnt he call the grandparents..thats part of job..

I now live back in the White Pass school district , also my high school many years ago and I agree on her assessment of the school counselors then, and according to my grandchildren it is no better now. My Grandchild recently told me that the school councelor was the last person she would talk to about ANYTHING , as this person would blab , and everyone knew it. I am close to my Grandchild, but I have known there to be good counselors at White Pass in the past and I certainly took advantage of their services with my children, so I suggested the school councelor. My Grandchild just laughed. Same thing with the Bully situation there. They had big assemblies and experts come in and still it is a joke. And if the Bully is diagnosed with anything then they get away with whatever they feel like doing and the school either cannot or will not do anything. I hear this over and over. I have been outraged a few times and was told the perpetrator was in special ed so got away with murder and even attempted rape one time according to my grandchild. I do not know if their hands are tied or what , but it is easy to see how a depressed child could slip through the cracks , especially a well behaved child. Seems like the trouble makers get the attention and the quiet ones do not.White Pass has taken alot of hits the last few years and money for programs is not there.

    I was neighbors with Brian and his folks many years ago when he was very small. What I remember was that he had the most beautiful green eyes I’ve ever seen and his Grandpa Pete was a real big help to my son who worked at the the mill. Pete was a shop steward . I was no longer living in Packwood when Brian died but, I was very saddened to hear of it. I also knew his Dad since he was a very small child. He has always been very polite to me as has his mom. I pray for peace for this family.

  33. Want to know some more facts about the truth. I notice this article mentions Vaccinations. Vaccinations cause mental disease also. And there is no Law in Washington State that say’s one must be vaccinated. Think I’m Wrong. I doubt it. Want to know why? I have went to the Lewis County Health Department and Personally asked them to show me the law pertaining to vaccine’s. You know what, they will just hand you a phone number, because there is no law that requires vaccine’s in Washington State.     Brian was a good kid,he was good friends with my sons,it was very sad.As far as Justin neilsen as a counsler the district should have let him go, he was not educated enough as a counsler to deal with hi school kids,he acted like one himself,i was very disppointed in meeting him,i think the school district was deperate at the time to fill the counsler postition.He would not follow thru on his job,n i felt tormented a few kids..didnt listen to what they had to say.i was real happy to know he was leaving the district ..really white pass is a real small school..and he couldnt handle it..

  35. Let’s not blame it on the school at all. The fact is that using Fluoride and Drinking Fluoride can cause suicidal behavior. I’m sure that you have never heard of this before, but that’s exactley what the Government wants you to know, Nothing! Fluoride is the same product that is in many Anti-Depressents, so the fact that young adults are using it and drinking it is of great concern. Fluoride calcify’s the Pienal Gland and attacks one’s Thyroid and Bones. Just using Fluoride for a peiord of one year mentaly changes a person forever.
