PROSECUTOR SEEKS TO REVOKE BAIL FOR SOFTBALL COACH ACCUSED OF RAPE

• Former Pe Ell softball coach Todd D. Phelps was arrested yesterday evening at his home after a deputy was told he violated a protection order to stay away from a 17-year-old girl. Phelps, 52, is charged with third-degree rape in connection with an encounter last summer with the teenager. The girl’s mother told the deputy Phelps drove by the girl’s Pe Ell home about 3:30 yesterday; it was the third time he’d violated the order to stay 100 feet away from her, her home and her workplace, according to court documents. Deputy Prosecutor Debra Eurich filed a motion today to revoke Phelps’ conditions of release pending trial and to forfeit his $25,000 bail. Phelps was booked into the Lewis County Jail, according to the Lewis County Sheriff’s Office. Phelps told the deputy he thought he was more than 100 feet away from the house, but the deputy measured out approximately 80 feet, according to an incident report. Phelps’ trial is currently set for the week of February 21. His charges were increased last week to add special aggravating circumstances that Phelps used a position of trust with a particularly vulnerable victim.

OBSTRUCTION ARREST

• Centralia police reported a 43-year-old woman was arrested for obstructing and reckless driving last night when she failed to stop during an attempted traffic stop and then fled into a residence. The incident occurred just before 10 p.m. in the area of the 1200 block of Alder Street, according to police. Dannette L. Burgess, of Centralia, was booked into the Lewis County Jail, according to the Centralia Police Department.

CASH LIFTED FROM PURSE

• Centralia police were called about 9:10 p.m. last night by a woman who discovered $500 and her keys were missing from her purse. She later found her keys and said she thought the money may have been taken earlier in the day when she set her handbag on a counter at a business on the 200 block of South Tower Avenue, Officer John Panco said.

  1. RaginCajun says:

and justice for all makes a bullet ridden argument to give him the freedom and right to be a self serving judgemental BIGOT!!!! RIGHT ON!! Keep going….big dummy

  2. justiceforall says:

RajinCajin is a typical surface thinker. He is not smart enough to understand he is being manipulated. His only defense is to project his fear of stupidity onto others. He will continue to rage on anyone who to stands up against the backward rules of staying silent as if this give him righteous significance. He whines for the call of fairness toward the perp and his cohorts because as a male he harbors the same objectification of woman which feeds his irrational fear that women have an unfair sexual power and control over him and at any second he could fall victim. It is not for God alone to make judements in this life that is why we are equiped with a mind in order to reason.

  3. George says:

RaginCajun, just to let you know, misjudging 20 feet is no excuse for him to be within 100 feet of the girl or her house. If he was truly concerned about being within 100 feet of her house, he would not have even been withing a MILE of the house. To drive by there THREE TIMES, though, is just asking to get thrown in jail.

  4. SomeoneWhoCares says:

What gives any of you guys the right to judge him or her?

  5. RaginCajun says:

and Bugs….try to remove your head from the site moderators posterior….A$$ kissing is fairly unbecoming, however understandable in your “special” case…..”do your good work” sniff sniff. *wipes nose on shirt sleeve”

  6. SomeoneWhoCares says:

God is the only person whom should be judging this case, you all have your personal opinions but what gives you the right to judge him or her?

  7. RaginCajun says:

Again, you think you are so special. Use your brain….I stand corrected, you are an idiot.

and wait, my “relative”?….so once again you village idiots are so wise you think I’m defending a relative…..LOL. And I sound like a weirdo…..you people borderline KKK mentality. I will watch the news for the special outfits. And you are SO SMART, you infer the result will be tainted. So you are already posturing for further hatred and denial IF he is found not guilty.

So on your witch hunt…..of course you know Phelps is guilty so the statement above that indicates
“Phelps told the deputy he thought he was more than 100 feet away from the house, but the deputy measured out approximately 80 feet

So, there is NO WAY that he is telling the truth about misjudging 20 feet…..because you really smart dummies just know all there is to know….right? NO WAY HE IS TELLING THE TRUTH?….you are just all so special and knowledgable and credible….and smarter than the legal system altogether….WAY TO GO DUMMIES!! Keep the faith!!

  8. George says:

I just got two questions here:
    1) If he was given explicit instructions to NOT go within 100 feet of this girl, her house, he school/work… WHY would he even drive by the house? “Delivering wood to a needy family” doesn’t cut it. If he was innocent, would you not expect him to stay as far away from this girl as possible, in order to help his case? And the drive by THREE TIMES (that we know of)???

    2) If the prosecutors are going after getting the conditions of his release on bail revoked for multiple violations (see above), why was he permitted to AGAIN bail out of jail, and why has his case not been heard yet on the whole bail thing?

  9. Bugsy says:

For those that have jobs and need to work during this trial, I hope Sharon will do her usual wonderful and complete reporting of this case….

We can always count on Sharon to do an unbiased reporting of the facts and actual happenings of a case.

    Thanks Sharon !

  10. john doe says:

Hey, cage-em Rage-em, maybe you also got a good explanation for why your relative violated the restraining order? I am sure we would all be amused to hear your reason?

  11. Judge & Jury says:

any minne miney moe-my mother told me to pick the very best one: Guilty – not guilty-guilty-not guilty-guilty-not guilty- guilty.

Lets see the vote is 4 guilty to 3 not guilty.
If you were faced with a decision what would you do?

  12. use your brain says:

Well…. it is not like I need to justify myself Rajin… but I was merely taking a stab at the definition of your term “Phelps hater.” As for the term restroom lawyer, was that your attempt to be funny and then follow it up with a goofy song reference. You sound like a weirdo. As for acting like judge and jury no one here has the power to sentence anyone….. no one is on a witch hunt… or burning anyone at the stake… you are being a drama queen.
All of us here have the right to our point of view on this forum, to beleive who we want and to make judgements that will keep us and our families safe. To do otherwise and turn a blind eye to what we know would make us DUMMIES.

  13. Bugsy says:

    Ragin,

I didn’t say he was guilty, as my previous post notes I say “let the courts decide”

You seem to only point to the Innocence of the Charged, what will you do if he if found Guilty?

You have never pointed anyone to any Alibi’s to profess the innocence of this person. The prosecutor has provided (although from victim) several instances of abuse and a crime being committed.

All your Name Calling only makes you look small and smaller minded. Yes I called you small minded.

The courts will decide Innocence or Guilt. But please take those rose colored glasses off, as the result will either way will be tainted.

  14. RaginCajun says:

Slam the whole family? Wow, worse than I thought.

The fact that you looked up restroom lawyer on Google makes my point. Let’s go get educated on the internet, town bar, cocktail lounge, church or wherever, and sprinkle our wisdom on the world. (and it’s “armchair warrier” by the way…great Don Henley song)

Bugs, you’re just really convinced these two “had sex”. I’ll swing back around to my point: What crown are you wearing that gives you the right to make THAT decision when a Judge / Jury has not made it yet? Keep loving yourself. I wish I was all that and a bag of chips to raise myself above the law. I’ll keep my rose colored glasses on and watch the legal system perform its good work.

And yes, I am referring to you as DUMMIES. You are attempting to represent the legal system with your pre judgements, opinions, hatred and bias. You are all so sure, so convinced, so entitled to what you are certain of. You folks have turned this into a witch hunt…and you appear to be VERY comfortable doing so. You’re all CERTAIN you know the guilty party (s). What are you going to do if Phelps is found not guilty? Accept it? loot the town? grab hay and burn some folks at the stake?

  15. whatever says:

I don’t know anyone in this case, but I have known of three cases in my short years of sexual allegations going to court where I had “insider information”:

1 – A co-worker who came to work and told me about her kids’ softball coach who allegedly had sex with one of the teen players. He was proven innocent at the trial, but it ruined his life for that time, and that of his family. He was a “nicest guy” – church, coach, kids and one wife, etc. He couldn’t be around his team, his friends with kids, go to church, had to be “babysat” by his wife at all times…. INNOCENT

2 – At the church we attended for many years, we were adopted by the seniors as “grandkids”. One “grandfather” who was also an elder, in the choir, etc. was accused by his great-granddaughter of molestation. I was among the top in his camp. Well guess what? The sons had issues, the daughters had substance issues, the granddaughters had stories (and one a police report of the molestation), nieces had stories, secretaries had stories…. you’d still be calling him a “nice guy” if you didn’t know that he had done prison time. GUILTY and the jerk pleaded NO CONTEST. He wouldn’t even say “guilty”.

3 – A preacher’s kid in the bible belt told me of her court trial – two elders/deacons in her father’s church had been “tag-teaming” her since she could walk – during church hours when her father was preaching. When she finally called her retired preacher dad to tell him that she was taking the slimes to court, he doubted his daughter first because they were his two closest friends and “really nice guys”. When the two were questioned by police, they said that they had never hurt her, but were “loving” her. GUILTY

    All great guys, right?

  16. Bob says:

First of all, all of you dont know what really happened! All of you have no right to come on here and dis the whole Phelps family. I have spent time with Todd and his family, all of them would do anything to help someone out. they would give the shirt off their back to someone in need. Todd is a wonderful man and his wife is the biggest sweetheart i have ever met. Isn’t it funny how everyone is innocent until proven guilty but when you are accused of something like this you have to prove your innocence? it is unfortunate that this is happening to such a great family!

  17. letsgetreal says:

Josh Powell told everyone is was innocent, if you watch his interview on Dateline you can tell he was lying like the fool he was. Fact was he was raised by a sexual predator himself. and in the end it was his wife and children who paid for his sickness.
As for being called a dummy and a restroom lawyer, how do you know “rajun” I’m not a lawyer. If I was advising them I would have them slap a stalking protector order on as well.

  18. use your brain says:

Okay…. I get what a phelps hater is which is a person that likely knows the family and their patterns but what the hell is a restroom lawyer, lol….. Even Google couldn’t help me. Do you mean armchair lawyer?

  19. sadly watching the pain says:

As for the people that followed him and “blocked him in his driveway”. I’d like to know if all the kids that drive that way from school and the and all the school busses also “block” him in, because that’s where they were parked. I was watching from the school parking lot and saw it. It was only someone that actually had to see him and not through those dark windows to prove it this time since the last 2 times they were told they couldn’t see through the windows to be sure it was him driving. Sad when good people have to go to such lengths to get someone that has such total lack of respect for the law that he thinks he can keep doing this.
As for being a window peeper, I guess your house has no windows so you don’t ever look out just to be looking out. Oh poor phelps happened to be seen by a “peeper” wwwwhhhhhaaaaaa

  20. Saban says:

He knows he wasn’t allowed to drive on that road. Simple as that. How could you be so blatantly ignorant to violate a protection order? Is he really that foolish? Apparently. Why didn’t his wife go and retrieve the trailer herself? Why didn’t his brother bring the trailer to him? Why did HE physically HAVE to go on a road that the judge ordered him to not drive on. One of the only places on earth he was told not to be and he just HAD to go there. What an ignorant fool. He’s the one looking for drama and he got it, with a hefty price tag. The jury is going to have no trouble with this one.

  21. Bugsy says:

    Ragin,

I think any SANE person would consider a 52 yr old man having sex with a 16 yr old girl WRONG.

Do you really think that the prosecutors would have taken this case this far if they didn’t have the evidence to convict?

Do you think that the prosecutors really think this is a he said she said situation with out proof?

What about the bags of evidence removed from the brothers home where the SECOND incident supposedly happened.

I am not saying he is guilty, the courts will decide that.

BUT any 52 yr old man who is close enough to any 16 yr old girl to even Dream up this story, and didn’t squash it in the beginning by marching her butt to her parents house is in need of some help.

If she was making it up, he should have done something about it a year ago, and not engaged her further with Texts to her and her friends.

Furthermore, it is ironic that he seems to know when the victim is home, as when he has violated the protection order (3 times) when she has been home.

So if you need to call us all Dummies, do so. But at least I don’t wear Rose Colored Glasses. I look at the whole picture and don’t plug my ears and go waaaa waaaa waaa

  22. RaginCajun says:

Hmmmm….we now have Phelps haters and restroom lawyers….and self serving pontifs that hide behind scripture….Albeit interesting and all…you people are still missing the point. WHO made you judge and jury? The very country that allows you to spout that religious free lingo without being burned at the stake or beheaded also scripts that a man is “innocent until PROVEN guilty”. Again, why is it so hard to lay down your spears and flaming torches and let justice run the path?

    YA BIG DUMMIES

  23. Hilarity ensues says:

Yes because as we all know the Phelps’ are the picture perfect embodiment of altruism… *snort*. “Poor innocent man getting drug through the mud by these people who obviously have nothing better to do with their lives…” For some reason I’m not convinced. I’ve lived in, and been associated with this community for quite some time, and the Phelps clan has always been known for their blatant lack of integrity. They can get behind their faux online screen names and post on internet forums all they want to try and convince people otherwise, but everyone that has ever really interacted with them knows the truth. I actually find it to be quite ironic, and somewhat darkly humorous that this man has any support at all. It is most certainly a dark and pathetic age we live in when the rights and safety of our youth are trampled over for “home-town” politics, and peoples petty religious ideology. Shame on every one of you.

  24. Live, Laugh, Love says:

    Amen!

  25. letsgetreal says:

    Proverbs 28

1 The wicked are afraid of everything, but those who live right are as brave as lions.

2 A lawless nation will have many bad leaders. But a smart leader will rule for a long time in a land where people obey the law.

3 A leader who takes advantage of the poor is like a hard rain that destroys the crops. [a]

4 Those who refuse to obey the law promote evil. Those who obey the law oppose evil.

5 The wicked don’t understand justice, but those who love the LORD understand it completely.

6 It is better to be poor and honest than rich and evil.

7 A smart son obeys the laws, but a son who spends time with worthless people brings shame to his father.

8 If you get rich by charging high interest rates, your wealth will go to someone who is kind to the poor.

9 When people do not listen to God’s teachings, he does not listen to their prayers.

10 Those who plan to hurt good people will fall into their own traps, but good things will happen to those who are good.

11 The rich always think they are wise, but a poor person who is wise can see the truth.

12 When good people become leaders, everything is great, but when the wicked rise to power, everyone hides.

13 Whoever hides their sins will not be successful, but whoever confesses their sins and stops doing wrong will receive mercy.

14 People who respect others will be blessed, but stubborn people will have plenty of troubles.

15 An evil ruler over those who are helpless is like an angry lion or a charging bear.

16 A foolish ruler hurts the people under him, but a ruler who hates wrong will rule for a long time.

17 A murderer will never have peace. Don’t support such a person.

18 Honest people will be safe, but dishonest people will be ruined.

19 Whoever works hard will have plenty to eat, but whoever wastes their time with dreams will always be poor.

20 People who can be trusted will have many blessings, but those who are just trying to get rich in a hurry will be punished.

21 It is wrong for a judge to support someone simply because he knows them. But some judges will change their decisions for the price of a loaf of bread.

22 Selfish people only want to get rich. They do not realize that they are very close to being poor.

23 Correct someone, and later they will thank you. That is much better than just saying something to be nice.

24 Someone might steal from their parents and say, “I did nothing wrong.” But that person is as bad as an enemy who smashes everything in the house.

25 Greedy people might sue you in court, but those who trust the LORD are rewarded.

26 It is foolish to be too confident. Those who ask for advice are wise and will escape disaster.

27 Whoever gives to the poor will have plenty. Whoever refuses to help them will get nothing but curses.

28 When the wicked rise to power, everyone hides. When they are defeated, good people multiply.

I too thank god for his teachings…

  26. Sadly watching the pain says:

Kind of nice that Phelps kept getting the trial held off because he thought his VICTIM wouldnt go through with getting the truth out. He is helping the truth come out by showing his total lack of respect for her family and the law. True colors shining through.

  27. Live, Laugh, Love says:

Thank you Jesus that in the end we just have to answer and be judged by ONE!

  28. letsgetreal says:

I’d call rajincajun a sadistic, but that would be beating a dead horse.

  29. RaginCajun says:

Look at all the restroom lawyers in the house! While the justice system runs its course…you big dummies should just go on about your business…..Or you can keep popping off at the mouth blessing the public with your wisdom and virtues. After all, this is almost over right 🙂

  30. letsgetreal says:

Its funny to me with all that is going on in this world that ragincajun is so immature.
Violating a no-contact order is a crime when it is part of a criminal sentence or a condition of bail or probation. Police WILL make an arrest when they suspect the offender has violated the order. These orders should be taken VERY seriously and abided by carefully. Violating these orders is a crime.
And also know that people can’t read minds. It is a families right to protect their home and family. And they had did that by getting the no contact order. People shouldn’t think that they are above the law.

  31. Bugsy says:

Ragin, I hope you never need a Protection Order, but if you do I hope you will appreciate those hawk eye window people when they spot the perp and report him/her in the interest of YOUR safety.

And further more, when you are told by the courts to not do something, why would you do it?

  32. john doe says:

Intimidating is when you know you’re violating a restraining order when it’s clear that you are to stay away 100 feet. looks like the suspect is going to be in debt 25,000 dollars. Yes he might be only out the $5000, but when you violate any conditions of a restraining order, now the bailsbondsman can go after the other $20,000 plus interest. Sounds like the suspect is lacking on smarts about as much as my spelling is as worse as those that live in the west Lewis County
By the way-I also like looking out my window-suppose that is wrong too?

  33. RaginCajun says:

Yes…yes…it’s intimidating to go get firewood for needy people. What’s more intimidating is the hawk eye window peepers just looking for some trouble to stir up. Drama seekers.

  34. john doe says:

    comments,
#1 guess what everybody, there is another route to the firewood and trailer foe which he could of went without violating the 100 foot.
#2 It was at his brothers house, so it also would of been possible to have his brother fetch the trailer or firewood, or have somneone else fetch it so he would not have put himself in that position.

    sound like possible intimidation

  35. letsgetreal says:

A person who is on probation, bail or a probation attached to a suspended sentence must be even more vigilante in order to not violate the no contact order. A violation is a crime in itself which is also a violation of the conditions of probation, filing or bail.

The judge told him not to use that route to go to his brothers under any circumstances, just as the superintendent told him not to text his players. Seems to me someone has authority issues. And when a judge tells you not to do something you listen, you just don’t go out and do want you want.

  36. justshakingmyhead says:

  37. Sadly watching the pain says:

I agree that other people from the church should have taken the wood. Once again Phelps has proven he thinks he is above the law!! And I will never understand why his wife would go along with this foolish and very selfish act!
Phelps goes to church “now” kind of a joke I’m thinking. And for the minister to not even reach out to the other family who truly deserve it and supported the church when “not hiding” in it, sure has me wondering.

  38. Bugsy says:

According to LLL, the suspect had to drive by the the girls house to get a trailer to deliver such wood,,,,,Why didn’t the brother take the trailer to Todd’s home to acquire the trailer…. Todd knew the consequences.

  39. Bugsy says:

Why would this Suspect and his Wife would even be driving within 5 miles of the girls home is beyond me, and why isn’t he in Jail

There are plenty of parishioners that could have hauled that wood to that needy person .

  40. RaginCajun says:

AMEN LLL!! Glad you stepped in with the real story. What a sad saga this has become with the side taking and the verdicts of guilty before the justice system runs its due course. Praying for the truth to come out soon.

  41. Live, Laugh, Love says:

Not that I am on any side here, but Todd and HIS WIFE were on their way to get fire wood for a needy family and drove by the girls house (on a side road from the girls house) in order to get a trailer at his brothers house to take a large amount of wood to this family. Just FYI

  42. George says:

And apparently, he is out on bail once again. So, the judges have failed to do their duty once again….

  43. George says:

Sounds like Phelps isn’t helping his case any….
