FROM THE COURTHOUSE

• The rape trial in which the prosecutor is afraid the victim’s bad heart won’t hold out having to face her alleged attacker began this afternoon, with testimony from the victim. Leo B. Bunker III, 53, of Winlock, is charged with two counts of second-degree rape, one count of harassment and two counts of violating a protection order in connection with a woman who says he physically abused her during their short marriage in late 2011. He was charged in December of that year and has been locked up since awaiting trial. Prosecutors last week unsuccessfully attempted to allow the victim to testify via video, because her doctors have said the stress could kill her. Defense attorney Michael Underwood last week was denied a request to get the trial postponed because his client who is recovering from throat cancer and treatment doesn’t have a very strong voice with which to assist his attorney in the courtroom. The trial in Lewis County Superior Court took an early recess after the victim had been on the stand about an hour and half today. Lewis County Deputy Prosecutor Joely O’Rourke and Underwood spoke to the judge at his bench while the jury was on a break. Judge James Lawler afterward said only that given the situation, court would reconvene at 9 a.m. tomorrow. O’Rourke said she expects to finish questioning the victim in the morning.
