Prosecutor: Intimidation appears to be motive behind attack on man at Centralia motel

CHEHALIS – The victim of a beating that led to a nighttime police search through a Centralia neighborhood for suspects was a key witness in a trial that ended earlier this week in the conviction of a fellow heroin user.

Thomas Pennypacker, 32, of Chehalis, testified against Lonzo Lawson who was sentenced to more than eight years for breaking into a Napavine bar and stealing almost $15,000.

But that’s not what prosecutors think necessarily specifically led to the events on Tuesday night in the parking lot of the Peppertree Motel on Alder Street.

“I’m inclined to believe this is related to other individuals,” Lewis County Deputy Prosecutor Shane O’Rourke told a judge.

The suspects allegedly called Pennypacker a snitch and said they were going to kill him as he was choked, repeatedly shocked with a stun gun and punched in the face. He escaped the car he had arrived in with the men and ran to the motel office for help, according to charging documents. The car sped away and two of the three men from it were captured in the area within the next hour and a half, according to police.

The Centralia Police Department initially said the victim was with the subjects because he was trying to buy heroin.

O’Rourke said it looked like a beating under the guise of a drug deal. “A pick ’em up payback kind of thing,” he said.

He wouldn’t confirm if Pennypacker was one of law enforcement’s so-called confidential informants, drug case defendants that can get certain plea deals if they cooperate with police in setting up drug dealers.

“All I can say is he is involved in cases with the state,” O’Rourke said yesterday afternoon, noting the recent trial.

Yesterday in Lewis County Superior Court, two of the three suspects were charged with multiple offenses including intimidating a witness. Judge Richard Brosey ordered them held on $250,000 bail pending their trials.

Joseph M. Hanks, 30, is from Rochester. He was described by Pennypacker as “somewhat of a friend” who picked him up Tuesday night because they were going to buy some heroin.

Elijah M. Garibay, 25, has an Elma address listed as his residence in court documents.

Pennypacker indicated in the documents he didn’t know Garibay, that he was just one of two men Hanks unexpectedly picked up as they were driving to get drugs.

Charging documents give the following account:

A Centralia officer interviewed Pennypacker at the hospital where he was being treated for his injuries, which included Taser injuries along his face and shoulder.

Pennypacker told the officer he hadn’t known anyone else was coming with him and Hanks, and it concerned him when the two men were picked up.

He said after they arrived at the Alder Street motel, he handed $60 to Hanks, who gave it to one of the passengers. That man got out and almost immediately Garibay who was in the backseat put his arm around Pennypacker’s throat and began strangling him. Then Garibay began Tasing him in the face and side.

Hanks got out and began punching Pennypacker in the face full force, he said.

That’s when they called him a snitch and said they would kill him. Then he fled to the motel office and they sped away in Hanks’ Honda.

Motel manager Kaitlin Mendonca, in her vehicle, chased the car to the nearby dead end of Long Road, where they got out and left on foot.

The 25-year-old said today she wasn’t really sure what she was doing, but wasn’t going to let them just drive away.

Court documents indicate Hanks was spotted in a field and turned himself over to officers.

Later in the night, law enforcement was advised a resident few blocks to the north was holding at gunpoint a suspicious male discovered in a yard.

Dan Henderson, 44, and a Centralia city council member, turned the man – who was Garibay – over to arriving officers. Some of his clothing he had allegedly shed was found nearby.

Police said yesterday no heroin was found when the car was searched. Police did find a stun gun, drug paraphernalia and small plastic bags, among other things, according to charging documents.

It’s not clear who the third suspect is, but charging documents for Garibay and Hanks which describe the evening’s events don’t mention the third man assaulting the victim.

Garibay and Hanks are each charged with intimidating a witness, second-degree assault, second-degree robbery and harassment.

Garibay’s prior convictions include one felony and 11 misdemeanors. Hanks’ include five felonies and 20 misdemeanors.

Their arraignments are scheduled for June 27.

    Your response to such a statement would be something like:
    “So in your perfect world, cops who shoot or beat their significant others walk free while some who accidently slapped a mosquito on their wife should be shot! What a twisted bastard you are to believe that cops are above the law and continue to cover for each other. Why do only .001% of all domestic violence that include cops do any jail time, while the rest of us have a 99.9% conviction rate? Tell me that’s not a conspiracy!”

    You twist the position of the poster, then pull numbers out of thin air (notice I was polite about where the numbers came from) then present them as if it’s somehow believable facts. The best part is how shocked you are when someone calls BS on it.

    How would any of you feel to be victimized by a robbery by three people, but only one of them went to jail?

    And in this particular case, both Pennypacker and the other witness (Dawkins) against the accused, benefitted from the proceeds of this robbery but were allowed immunity from prosecution in exchange for their testimony when they are both just as bad (or worse) than Lawson himself. They didn’t give a shit about doing the right thing, they just wanted to save their own asses. They are both unemployed, uneducated, lying, lazy, thieving dope fiends who belong in jail forever. In spite of their disease, SOME addicts work, pay taxes, care for their families and don’t commit crimes like theft and fraud to support their habits. They are few and far between, but they do exist. It’s not the addiction that makes tweakers and junkies horrible people. It is their lack of morality and inability to accept responsibility for themselves and their actions. It’s their sickening tendency to justify all the shitty things they do to harm others in order to continue using. Some high school graduate that smoked a few joints is in no way like these pieces of shit that don’t work for a living and support their habits by stealing from those that do, bleeding the welfare and/or disability system, or a combination of both, that need to be eradicated. It’s a proven fact that no matter what a society does, a certain percentage of their population will be addicts – people that suffer from the disease of addiction. Legalization, harm reduction programs and longer, stiffer jail sentences for those that commit thievery and fraud would go a long way to make things better for us all, but you’ll never see that happen because our government makes too much money off the “war on drugs” and the prison industry to allow that to take place.

All it has to do with is the fact that they did the crime and now they don’t want to man up and do the time.     No doubt the “status’ of the snithes is used as an excuse to keep that information from defendents in court cases or that information is not allowed to be used at all.

    How would you feel if you were in court over something you were completely innocent of and the only witnesses against you were heroin junkies and career-criminals you only know in passing, or not at all?

    This kangaroo style of convicting criminals has been going on for so long in Lewis County that it has become institutionalized practice. The worst part of it is, the police are breaking the law and there’s not one person willing to hire a lawyer or ACLU to sue or even ask for a Justice Dept. Audit of their ‘crime-fighting’ methods.

    Your civil rights amount to a pile of dung in Lewis County. And when I say this, I’m saying it as sincerely as possible, Good Luck Finding Justice.

    I think it’s BS that one drug dealer gets off free and clear because he stands up, points a finger, and says, “But, but, they did it too!..They are worse than me!… Take them not me!” It’s disgusting and pathetic. Like I said before, if the cops had to do their jobs instead of relying on one addict to ratt out another, sh*t would get deep around there.     So does that mean that Dan Henderson will face gun charges. Non of the charges happened in his view, non of the charges happened on his property, no one attempted to enter his house, the suspect was not on his property. How did he know it was the person the cops where looking for. Under federal laws listening to a police scanner and using it to commit a crime is a felony. Walking out doors and looking around does not give no one the right to have a gun pulled or look over a fence and point a gun at know one. In my point of few Mr. Henderson over step his legal right as a citizen. He took that person right to movement away and false arrest should started it. What if this would not have been the person they was looking for and some one just sleeping there or resting or something. Mr. Henderson had no right to pull, point his gun at know one unless they was in his house or threating him or his family.

    If Pennypacker is a CI & is currently or has in the past helped with convictions. He would have had to sign a contract that he can’t use, buy or sell illegal drugs. Any activity of that kind makes All those drug cases invalid, as he can not be used as a credible witness. There are a lot of drug dealing snitches in Lewis County. I thought the idea of being a confidential informant was to get a reduced charge for yourself and by doing that you were also required to get clean from that activity. That’s doesn’t appear to be how it works here. Someone from Higher up outside of this county needs to come in & investigate.
